PRIVACY POLICY

  1. INTRODUCTION

    1. Welcome to MyBazaarConnect, which is operated by DTDC 3PL (“MyBazaarConnect”, “MBC” “we”, “us”, or “our”). MBC operates an online platform (“Platform”) that enables users to browse, select, and sync orders for products and services, including through interactions with independent sellers, logistics partners, and other service providers (as registered on with DTDC 3PL platform).

    2. This Privacy Policy (“Policy”) explains how we collect, use, store, disclose, and protect your Personal Data (defined below) when you access or use the Platform and the services made available through it. It also outlines the rights available to you and the manner in which you may exercise them under Applicable Law.

    3. Unless otherwise defined in this Privacy Policy, capitalised terms will have the same meaning as assigned to them in our Terms of Service (“Terms”). You may access the Terms here: [MBC - Terms of use]

    4. By accessing or using the Platform, you agree to comply with Applicable Law and to be bound by our Terms, which govern your use of the Platform.

    5. We may update this Policy from time to time to reflect changes in law, technology, or our operational practices.

    6. If you do not agree to our use of your Personal Data as per this Policy, you must discontinue use of the Platform and the services.

  2. APPLICABILITY

    1. This Privacy Policy applies to all individuals and entities who access, browse, or use the Platform or the services made available through it (“Users”, “you”, or “yours”), including:

      1. resellers, registered users who select products listed by sellers on the Platform and sell those products through their own sales channels, while using the Platform to place orders and manage fulfillment;

      2. sellers, being registered suppliers, whose products are listed, marketed, and sold on the Platform;

      3. logistics partners, being courier or delivery partners who facilitate delivery of products from sellers to buyers;

      4. visitors and other users who interact with the Platform in any manner.

    2. This Policy governs the collection and processing of personal data when you browse the Platform, create or use an account, place or fulfil orders, onboard or operate as a seller, perform logistics or delivery services, communicate with us or other users, or otherwise use any feature of the Platform.

    3. This Policy also applies to Personal Data that we receive from Third Parties who support the operation of the Platform, including payment gateways, logistics and courier partners, DTDC channel partners, and compliance, verification, or onboarding service providers. Such Personal Data is used only for legitimate business purposes and in accordance with Applicable Law.

    4. This Policy does not apply to any third-party websites, applications, or services that may be accessed through links on the Platform.

    5. We encourage you to review the respective privacy policies of such third-party websites, services, or applications, as we are not responsible for how they collect or process your Personal Data.

  1. DEFINITIONS

    1. For the purposes of this Policy, and unless the context otherwise requires, the following terms shall have the meanings set out below:

      1. “Account” means the User account voluntarily created by you on the Platform to access or use its features.

      2. “Applicable Law” means the Information Technology Act, 2000 (“IT Act”), the Digital Personal Data Protection Act, 2023 (“DPDPA”), the Digital Personal Data Protection Rules, 2025 (“Rules”), and any rules, notifications, or regulations framed thereunder, together with any other applicable data protection or information technology laws as may be notified, amended, re-enacted from time to time.

      3. “Personal Data” means any data about an individual who is identifiable by or in relation to such data and which is processed in digital form.

      4. “Processor” means any third party engaged by us to process personal data on our behalf and under our instructions, including (but not limited to)service providers supporting payments, hosting, analytics, customer support, or logistics.

      5. “Third Party” or “Third Parties” means any independent service provider, vendor, or partner engaged to support the operation of the Platform.

  3. We may request limited additional information from you, where necessary, to verify your identity before responding to your request. This verification step helps ensure that Personal Data is shared only with you or with someone authorised by you.

  1. PERSONAL DATA WE COLLECT

    1. We collect certain categories of personal data when you access or use the Platform. The type of personal data collected depends on whether you use the Platform as a buyer, seller, logistics partner, or visitor, and on how you interact with the features and services offered through the Platform.

    2. From Resellers: We may collect the following Personal Data of buyers:

      1. name, email address and phone number;

      2. billing and delivery addresses;

      3. order and transaction details;

      4. payment references relating to payments processed through third-party payment gateways; and

      5. records of communications with customer support.

    3. From Resellers & Sellers: We may collect the following Personal Data:

      1. business name and business details;

      2. contact details of authorized representatives;

      3. GST number, PAN and bank account details;

      4. KYC and compliance documents;

      5. product listings, pricing and inventory information; and

      6. order fulfillment and performance-related data.

    4. From Third Parties: We may receive personal data from third parties that support the operation of the Platform, including payment gateways, logistics and courier partners, DTDC channel partners, and compliance or onboarding service providers. Such data is used only for legitimate business purposes and in accordance with Applicable Law.

    5. Children’s Data: The Platform is intended for persons who can form a legally binding contract under Indian law. We do not knowingly collect personal data from individuals under eighteen (18) years of age. Where required, Personal Data of children is processed only in accordance with Applicable Law, including upon obtaining verifiable parental or guardian consent. 

  2. HOW WE COLLECT YOUR PERSONAL DATA

    1. We collect Personal Data through the following sources when you use or access the Platform:

      1. Information You Provide Directly: We collect Personal Data that you provide directly when you register or use an Account on the Platform, place or fulfil orders, onboard or operate as a seller, communicate with customer support, submit queries or feedback, or otherwise interact with features of the Platform.

      2. Information Collected Automatically: When you access or use the Platform, we may automatically collect certain Personal Data, including IP address, device and browser information, log files, usage data, and information relating to your interactions with the Platform, including through cookies and similar technologies.

      3. Information from Third Parties: We may receive Personal Data from Third Parties and Processors who support the operation of the Platform, including but not limited to, payment gateways, logistics and courier partners, DTDC channel partners, and compliance, verification, or onboarding service providers, where such Personal Data is required to provide services on the Platform or to comply with Applicable Law.

      4. Information from Public or External Sources: In some cases, we may obtain Personal Data from publicly available sources or from external platforms that you choose to interact with in connection with the Platform. Such Personal Data is used only where necessary to verify information, respond to queries or feedback, or support the operation of the Platform, and in accordance with Applicable Law.

  3. GROUNDS FOR COLLECTION OF YOUR PERSONAL DATA

    1. We collect and process your Personal Data only where there is a lawful basis to do so. Depending on how you use the Platform, this may include situations where:

      1. you have given us your consent for such processing;

      2. you voluntarily provide Personal Data for a specific purpose, such as creating or using an Account or transacting on the Platform;

      3. the collection or processing is necessary to comply with a legal or contractual obligation; or

      4. the collection or processing is necessary for legitimate purposes as per Applicable Law.

  4. WHY WE COLLECT YOUR PERSONAL DATA

    1. We use your Personal Data for purposes that are directly connected with the operation of the Platform and the features made available through it, including the following:

      1. Account creation and management: To create, maintain, and manage your Account, and to enable access to and use of the Platform.

      2. Platform transactions and operations: To facilitate buying and selling on the Platform, including order placement, order fulfilment, payments, refunds, and settlements.

      3. Reseller  onboarding and compliance: To onboard resellers, carry out verification and compliance checks, and manage reseller-related obligations on the Platform.

      4. Safety and Security: To help maintain the safety and integrity of the Platform and your Account, including but not limited to, preventing fraud or misuse and monitoring relevant diagnostic or security signals.

      5. Logistics and delivery: To coordinate logistics, track shipments, and enable pickup and delivery of products through logistics and courier partners.

      6. Internal analytics: To carry out internal analytics, research, and reporting, in anonymised form where practicable.

      7. Platform Improvement: To improve the functionality, performance, and User experience of the Platform.

      8. Legal requirements: To comply with obligations under Applicable Law and respond to lawful requests from authorities.

      9. Communication and support: To communicate with you regarding transactions, updates, and Platform-related features, and to provide customer support, grievance handling, and dispute resolution.

    2. We do not process Personal Data for purposes that are unrelated to or inconsistent with the above unless required under Applicable Law or permitted by your consent.

  5. ACCURACY OF YOUR PERSONAL DATA

    1. We rely on you to ensure that the Personal Data associated with your Account is accurate, complete, and up to date. The information you provide enables us to operate the Platform effectively, maintain the reliability of your Account, and contact you when required.

    2. If any of your details change, including your contact information, preferences, or documents submitted for verification, please update them promptly through the Platform or by contacting our Grievance Officer at reseller@mybazaarconnect.com

    3. We are not responsible for any delays, issues, or service limitations that may arise from inaccurate or incomplete information provided by you.

  6. CHANGE IN PURPOSE

    1. We will use your Personal Data only for the purposes described in this Policy or for purposes that are reasonably connected to your use of the Platform and features within.

    2. If we ever need to use your Personal Data for a new purpose that is not covered by this Policy, we will inform you of the change and, where required under Applicable Law, seek your consent before proceeding.

    3. We may also process your Personal Data without additional notice or consent where such processing is permitted under Applicable Law, including but not limited to, when it is necessary to prevent fraud, maintain the security of the Platform, or comply with legal or regulatory requirements.

  7. SHARING OF DATA

    1. We value your privacy and do not sell your Personal Data to any unauthorised Third Party.

    2. We may share Personal Data only to the extent necessary for the operation of the Platform and for the purposes described in this Privacy Policy, including in the following circumstances:

      1. Transaction and order fulfillment: Personal Data may be shared to enable transactions on the Platform, including:

        1. sharing buyer details with sellers for order fulfillment;

        2. sharing seller and partner details with buyers for transaction transparency; and

        3. sharing order-related information with logistics and courier partners for pickup, shipment, and delivery.

      2. Service Providers: We may share Personal Data with Third-Party service providers engaged to support the Platform, including providers assisting with

        1. payment processing;

        2. IT infrastructure and hosting;

        3. customer support tools; and

        4. analytics and security services.

      3. Legal and regulatory requirements: We may disclose Personal Data where required under Applicable Law, pursuant to court orders, or lawful requests from governmental or regulatory authorities, or where necessary to protect the rights, safety, or security of DTDC 3PL Platforms, its Users, or the public.

      4. Business transfers: In the event of a merger, acquisition, restructuring, or sale of assets, Personal Data may be transferred as part of such transaction, subject to this Privacy Policy and Applicable Law.

  1. CHILDREN’S DATA

    1. The Platform is intended for individuals who are capable of forming a legally binding contract under Indian law. We do not knowingly collect or process Personal Data of individuals under eighteen (18) years of age. Where the Personal Data of a child is required to be processed, such processing shall be undertaken only in accordance with Applicable Law, including upon obtaining verifiable consent of the child’s parent or lawful guardian.

    2. We do not knowingly collect Personal Data of individuals under eighteen (18) years of age. If we become aware that such Personal Data has been collected without the required parental or guardian consent, we will take reasonable steps to address the matter, including deleting such Personal Data where required under Applicable Law. Parents or legal guardians may contact our Grievance Officer at reseller@mybazaarconnect.com to report any such concerns.

  2. STORAGE AND RETENTION OF YOUR PERSONAL DATA

    1. We retain Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or until consent is withdrawn, as applicable.

    2. All Personal Data is handled using reasonable technical and organisational safeguards designed to protect it from unauthorised access, loss, misuse, or alteration.

    3. Personal Data may be retained for longer periods where required to comply with Applicable Law, or to prevent fraud, resolve disputes, or enforce legal rights.

    4. Where Personal Data is no longer required for the purposes described above, we take reasonable steps to delete it or render it anonymised so that it no longer identifies an individual.

    5. Anonymised or aggregated data may be retained for analytics, research, or reporting purposes in accordance with Applicable Law.

  3. YOUR LEGAL RIGHTS

    1. As a user of the Platform, you have certain rights in relation to the Personal Data we hold about you. These rights help you understand and manage how your information is used.

      1. Right to Access Information: You may request details of the Personal Data we hold about you and how it is used, including the categories of data collected, the manner of processing, and the parties with whom it has been shared.

      2. Right to Correction, Completion and Deletion: You can ask us to correct any inaccurate information, complete any incomplete details, or delete your Personal Data where it is no longer needed for the purposes for which it was collected.

      3. Right to Withdraw Consent: If you have given us consent to use your Personal Data, you may withdraw it at any time by contacting our Grievance Officer at reseller@mybazaarconnect.com.

      4. Right to Be Informed: You have the right to know why your Personal Data is being collected, how it will be used, and with whom it may be shared. This Policy forms part of our commitment to keeping you informed.

      5. Right to Grievance Redressal: If you believe that your Personal Data has been handled in a manner inconsistent with this Policy or Applicable Law, you may raise a concern with our Grievance Officer. We will review and respond to your concern within a reasonable time.

      6. Right to Nominate: You may appoint another individual to exercise your privacy rights on your behalf in the event of your death or incapacity due to illness or other reasons.

    3. We may ask for information to confirm your identity before processing your request so that your Personal Data is shared only with you or someone you have authorised.

  4. CONTACTING THE DATA PROTECTION BOARD

    1. If you are not satisfied with the manner in which we have addressed a concern or responded to a request relating to your Personal Data, you may escalate the matter to the Data Protection Board of India in accordance with Applicable Law.

  5. EXTERNAL LINKS

    1. The Platform may contain links to third-party websites or services. Such third-party websites or services are not operated or controlled by MBC or DTDC 3PL Platform(s), and this Privacy Policy does not apply to any information collected by them.

    2. MBC or DTDC 3PL Platform is not responsible for the privacy practices, content, or handling of Personal Data by any third-party websites or services. We encourage you to review the privacy policies of such third parties before providing any Personal Data.

  6. DISPUTE RESOLUTION
